These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Vulcan Interactive LLC ("Company," "we," "us," or "our") governing your access to and use of the Luna AI platform and services (the "Service").

By creating an account, accessing, or using Luna AI, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

If you are using Luna AI on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

Each customer may maintain one account. Creating multiple accounts to abuse free trials or circumvent limitations is prohibited and grounds for immediate termination.

New accounts receive a 14-day free trial with limited usage (100 conversations, 500 messages). No credit card is required to start the trial. At the end of the trial, you must subscribe to a paid plan to continue using the Service.

AI Limitations: Luna AI uses artificial intelligence to generate responses. AI technology, while advanced, is not perfect and may occasionally produce inaccurate, incomplete, or inappropriate responses. You acknowledge and accept these limitations.

We do not guarantee that chatbot responses will be accurate, complete, current, or error-free. The quality of responses depends significantly on the knowledge base content you provide.

7.2 Not Professional Advice

Luna AI is a customer service tool, not a substitute for professional advice. Chatbot responses should not be relied upon as legal, medical, financial, or other professional advice. If you operate in regulated industries, you are responsible for ensuring appropriate disclaimers and human oversight.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or harmful components.

10.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VULCAN INTERACTIVE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at legal@lunaservice.ai and attempt to resolve the dispute informally for at least 30 days.

13.2 Arbitration Agreement

If we cannot resolve a dispute informally, you and Vulcan Interactive LLC agree to resolve any disputes through binding arbitration rather than court litigation, except for claims that qualify for small claims court.

Arbitration will be conducted by a mutually agreed arbitrator under the rules of the American Arbitration Association. The arbitration will be conducted remotely unless both parties agree otherwise.

13.3 Class Action Waiver

YOU AND VULCAN INTERACTIVE LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

You may opt out of the arbitration agreement by sending written notice to legal@lunaservice.ai within 30 days of first accepting these Terms. Include your name, email, and a clear statement that you reject arbitration.

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, labor disputes, government actions, or internet/infrastructure failures.

We may modify these Terms at any time. We will notify you of material changes by email and/or by posting notice on the Service at least 30 days before the changes take effect.

Your continued use of Luna AI after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and cancel your account.
